Terms of Service
This network provides web hosting to thousands of clients, and we have a responsibility to protect each client and provide the best services available. The following guidelines were designed to insure these services.
All services provided by this network must be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Postrock® Publishing Company from any claims resulting from the use of the service which damages the subscriber or any other party.
You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, nude, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Sex-related merchandising is also prohibited on all Postrock servers. This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to the reputation of our servers or any other server on the Internet.
Links to such materials are also prohibited.
In addition, any site selling or promoting bulk e-mail services is not allowed.
Examples of unacceptable content or links:
- Pirated Software
- Hacker's Programs or Archives
- Warez Sites
- IRC bots
- MP3
The Postrock Network will be the sole arbiter as to what constitutes a violation of this provision.
We are pleased to offer our Advanced Plan clients unlimited web-page traffic. To maintain the integrity of our service and provide all of our clients consistently high quality server responsiveness the following limitations apply.
If you have an average successful commercial web-site, you can expect to use less than 3 gigs of data transfer per month. Unless you fall under one of the below categories, your data transfer should not be of any concern. We do not limit the traffic of web-sites (except Basic Plan and Blog Plan web-sites) unless they fall under the below limitations.
Due to the unique resource characteristics and traffic patterns associated with certain web-sites, the following are limited to 5 gigs of free traffic:
- Sub hosting - any domain housing additional users
- Sites offering real audio/video or multimedia streaming
- Sites using more than 20% of system resources
- Shop cart web sites
- Shareware, sound, video, image and multimedia archives
- Mirror Sites or Distribution points
- Sites whose primary system load is discussion forums
- Sites whose primary system load is access to large audio, video or PDF files
- Any site whose primary purpose is file distribution
For sites that do not qualify for unlimited bandwidth, your traffic will go unmonitored until you reach 5 gigs. Thereafter, normal data transfer cost of 2.5¢ a meg per month, over the 5 gigabyte allowance will apply.
Postrock and its partners will be the sole arbiters as to what constitutes a violation of this provision.
Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however, we reserve the right to disable any CGI script that affects normal server operation.
We do not allow clients to install their own chat rooms. These tend to be large system hogs and we cannot allow it as an account option. However, we do provide a free basic Java chat room, and, for a small extra charge Volano Chat, that will more than fill your needs and run without hindering the performance of the machine for others.
We may allow programs to run continually in the background. These are considered on a one-to-one basis and an extra charge will be incurred based on system resources used and operational maintenance needed.
We currently do not allow IRC or IRC bots to be operated on our servers.
Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Advertising sites on other servers which in turn contain links to a domain on our servers is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and E-mail. If you are found to have spammed, then we will immediately, without warning, disable your domain. In addition, we will impose a $100 penalty for each spam policy violation. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy.
As such, any violation will result in immediate deactivation of services without refund.
Your privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices.
The Information We Collect:
This notice applies to all information collected or submitted to Postrock®. On some pages, you can order services and make requests. The types of personal information collected at these pages are:
- Name
- Address
- Email address
- Phone number
- Credit Card Information
The Way We Use Information:
We use the information you provide about yourself when placing an order or making a request only to complete that order or fulfill the request. We do not share this information with outside parties except to the extent necessary to complete the order or request.
Our Commitment To Data Security:
To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.
Our Commitment To Children's Privacy:
Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our Web site from those we actually know are under 13, and no part of our website is structured to attract anyone under 13.

Postrock promises 99.9% uptime and will only issue partial refunds for documented downtime performance reasons.
When someone orders one of our plans, we charge their card the same day. The server is configured, domain names are activated, and the customer is notified by e-mail within a maximum of 48 hours (routinely less than 24 hours) after the time the customer's payment has been authorized. Sometimes this process may be fulfilled in as little as 15 minutes.
We offer an unconditional 30 day money back guarantee for any of our web-hosting plans. If you are unhappy with our service for any reason, you may cancel within 30 days from the time the service starts. If you paid with a credit card, we will then "credit" your card the amount of your purchase in a timely manner. Please note, however, that any domain name registration fees incurred by us for your benefit are non-refundable.
You may cancel your account in writing or by faxing your request to 800-518-6850 at least 30 days in advance of the date you will no longer require our services. We do not accept email or phone cancellations. Services must be cancelled according to these instructions for account verification and tracking purposes.
Any attempt to undermine or cause harm to a server, or customer, of the Postrock Network is strictly prohibited.
Customer agrees that it shall defend, indemnify, save and hold Postrock harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Postrock, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Postrock against liabilities arising out of
- any injury to person or property caused by any products sold or otherwise distributed in connection with Postrock
- any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party
- copyright infringement
We reserve the right to refuse or cancel service at our sole discretion.
Postrock will not be responsible for any damages your business may suffer. Postrock makes no warranties of any kind, expressed or implied for services we provide. Postrock disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, and any and all service interruptions caused by Postrock and its employees and/or agents. Postrock reserves the right to change or update policies without notice.
If any terms or conditions are violated, it will result in grounds for immediate account deactivation.
These policies are designed to ensure that our normal web-hosting clients receive the best possible hosting experience. We care very much that our servers run smoothly and reliably. Adhering to basic net-etiquette will create a better all around hosting environment.
